INTRODUCTION<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms and Conditions (\u201cTerms\u201d) govern the access to and use of the Stayvolution platform (\u201cService\u201d), provided by:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Stayvolution is currently being tested in a limited private beta with selected hospitality partners. The service is operated by the project founder during the beta phase.<br>Email: <a>hello@stayvolution.com<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By accessing or using the Service, the user (\u201cCustomer\u201d) agrees to be bound by these Terms.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. DESCRIPTION OF THE SERVICE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Stayvolution is a software platform that enables hospitality operators to collect, manage, analyse, and act upon guest feedback, complaints, and experience data.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. ELIGIBILITY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is intended for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>businesses (hotels, property managers, short-term rental operators)<\/li>\n\n\n\n<li>individuals acting in a professional capacity (e.g. hosts)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer must be at least 18 years old.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. ACCOUNT REGISTRATION<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To use the Service, the Customer must create an account and provide accurate and complete information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is responsible for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>maintaining the confidentiality of login credentials<\/li>\n\n\n\n<li>all activities carried out under their account<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">5. SUBSCRIPTION AND BILLING<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">5.1 Subscription model<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is offered on a subscription basis, available in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>monthly plans<\/li>\n\n\n\n<li>annual plans<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">All subscriptions are <strong>paid in advance<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5.2 Free trial<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Service may offer a free trial period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a free trial is active:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Customer may be required to provide payment details at signup<\/li>\n\n\n\n<li>no charge will be applied during the trial period<\/li>\n\n\n\n<li>the first payment will be automatically charged at the end of the trial period<\/li>\n\n\n\n<li>if the trial is shorter than required by the payment provider, the charge may occur immediately<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">5.3 Billing and renewals<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Subscriptions renew automatically at the end of each billing cycle (monthly or annual)<\/li>\n\n\n\n<li>Each renewal is charged in advance at the beginning of the new period<\/li>\n\n\n\n<li>The Customer authorises the payment provider to charge the applicable fees automatically<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">5.4 Payment providers<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Payments are processed through third-party payment providers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Stayvolution does not store full payment details and is not responsible for errors or issues caused by such providers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. CANCELLATION AND TERMINATION<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer may cancel the subscription at any time.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cancellation takes effect at the end of the current billing period<\/li>\n\n\n\n<li>The Service will remain accessible until the end of the paid period<\/li>\n\n\n\n<li>No partial refunds are provided<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">7. NO REFUNDS<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All payments are non-refundable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No refunds or credits will be provided for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>partial use of the Service<\/li>\n\n\n\n<li>unused subscription periods<\/li>\n\n\n\n<li>downgrades or cancellations<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">8. ACCEPTABLE USE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer agrees not to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>use the Service for unlawful purposes<\/li>\n\n\n\n<li>upload or process personal data without a valid legal basis<\/li>\n\n\n\n<li>use the platform to send unsolicited or abusive communications<\/li>\n\n\n\n<li>interfere with or disrupt the Service<\/li>\n\n\n\n<li>attempt to access systems or data without authorisation<\/li>\n\n\n\n<li>reverse engineer, copy, or exploit the platform<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">9. CUSTOMER DATA<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer retains ownership of all data uploaded to the platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer is solely responsible for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the accuracy of the data<\/li>\n\n\n\n<li>the legality of the data collection and processing<\/li>\n\n\n\n<li>compliance with applicable data protection laws<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer may input personal data relating to guests. In such cases:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Customer acts as Data Controller<\/li>\n\n\n\n<li>Stayvolution acts as Data Processor, as defined in the <a data-type=\"page\" data-id=\"2147\" href=\"https:\/\/www.stayvolution.com\/data-processing-agreement\/\">Data Processing Agreement (DPA)<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">10. DATA USAGE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service enables the Customer to access, view, and manage guest feedback, including individual messages, complaints, and requests submitted by guests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such data is made available to the Customer to allow them to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>respond to guest feedback and requests<\/li>\n\n\n\n<li>address complaints<\/li>\n\n\n\n<li>improve their services, operations, and guest experience<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Stayvolution processes such data solely for the purpose of providing the Service, in accordance with the Data Processing Agreement (DPA).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Stayvolution may use data in aggregated and anonymised form for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>improving the Service<\/li>\n\n\n\n<li>analytics and performance monitoring<\/li>\n\n\n\n<li>product development<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Such data will not identify any individual.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">11. AVAILABILITY OF THE SERVICE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service is provided on an \u201cas is\u201d and \u201cas available\u201d basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Stayvolution does not guarantee:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>uninterrupted or error-free operation<\/li>\n\n\n\n<li>continuous availability of the Service<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Service may be modified, suspended, or discontinued at any time.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. LIMITATION OF LIABILITY<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To the maximum extent permitted by law:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Stayvolution shall not be liable for indirect, incidental, or consequential damages<\/li>\n\n\n\n<li>Stayvolution shall not be liable for loss of profits, revenue, data, or business opportunities<\/li>\n\n\n\n<li>Stayvolution shall not be responsible for decisions made by the Customer based on platform insights<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In any case, the total liability of Stayvolution shall not exceed the amount paid by the Customer in the 6 months preceding the claim.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">13. SUSPENSION AND TERMINATION<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Stayvolution reserves the right to suspend or terminate access to the Service if the Customer:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>violates these Terms<\/li>\n\n\n\n<li>uses the Service unlawfully<\/li>\n\n\n\n<li>creates risks for the platform or third parties<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">14. THIRD-PARTY SERVICES<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service may integrate or rely on third-party services (e.g. payment providers, analytics tools, communication tools).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Stayvolution is not responsible for the operation or availability of such services.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">15. DATA PROTECTION<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data is processed in accordance with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the Privacy Policy<\/li>\n\n\n\n<li>the Data Processing Agreement (DPA), where applicable<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">16. COOKIES<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service uses cookies and similar technologies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cookie management may be handled through external consent management solutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Further details are provided in the Cookie Policy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">17.
